President Cyril Ramaphosa has appointed Andy Mothibi as head of the National Prosecuting Authority (NPA). While Mothibi was not a candidate for interviews for the position of National Director of Public Prosecutions, President Ramaphosa stated that this is due to the panel finding none of the six interviewed candidates eligible for the position.
Speaking to VOC News, Doctor Suhayfa Bhamjee, Senior Lecturer in Criminal Law at the University of KwaZulu-Natal (UKZN), states that the appointment is odd. However, given the assessment by the panel, appointing Mothib was a logical choice for the President if he were to replicate his work in the SIU.
“Safe to say is that we do need an NDPP, as Shamilah Batohi’s term is coming to an end. There’s no two ways about it, and either way, the post needed to be filled. So because the six, according to the panel, weren’t appointable, the President used his constitutional mandate to appoint someone he deemed fit, but you’ll see, based on what has been said about Mothibi’s track record at the SIU, if that can be translated to the NPA,” stated Bhamjee.
