The Democratic Alliance’s (DA) justice spokesperson, Glynnis Breytenbach, is proposing a bill to amend three sections of the Constitution. The aim is to prevent impeached judges, such as former Judge President John Hlophe and former Public Protector Busisiwe Mkhwebane, from becoming members of Parliament.
Speaking to VOC News, Mbekezeli Benjamin, a researcher with Judges Matter, welcomed the move as a means to strengthen accountability.
He emphasized that it is essential to ensure that individuals removed from public office due to misconduct cannot re-enter politics through parliamentary positions.
Benjamin stated, “This is a positive move. While the bill only prevents these individuals from becoming members of Parliament, it does not bar them from holding any other public office in the country.”
“We believe a better approach would be to amend the relevant sections related to impeachment to include a provision that prohibits anyone who has been impeached from holding any public office, not just in Parliament.”
