PSA Welcomes ICJ Ruling Affirming Right to Strike Under International Law

The Public Servants Association (PSA) has welcomed a landmark ruling by the International Court of Justice affirming that the right to strike is protected under international law.

Union spokesperson Claude Naicker said the decision reinforces freedom of association and collective bargaining rights for workers globally, while also strengthening existing constitutional protections in South Africa.

He added that the ruling should guide policymakers in ensuring that labour rights are fully respected and called for meaningful engagement between government and social partners.

“The PSA has constantly defended the rights of public servants to organise, bargain, and, where necessary, withdraw their labour as a last resort to advance fair working conditions, equitable remuneration, and dignity in the workplace. Strike action remains a tool of last resort, but one that must be protected to ensure balanced power relations in the workplace,” Naicker said.
