Information Regulator Takes Matric Results Battle to Supreme Court of Appeal

The legal battle over the publication of South Africa’s matric results is set to continue after the Information Regulator (IR) filed an application with the Supreme Court of Appeal (SCA) seeking leave to appeal a judgment that permits the results to be published on public platforms.

The move follows last month’s ruling by the Gauteng High Court in Pretoria, which dismissed the Information Regulator’s application and found in favour of AfriForum and other parties. The case centres on whether the public release of matric results complies with the Protection of Personal Information Act (POPIA) or infringes on learners’ privacy rights.

As the matter heads to the Supreme Court of Appeal, questions remain over the balance between transparency, public access to information, and the protection of personal information.
