Brown Mogotsi may return to Madlanga Commission as second bail bid fails

North West businessman Brown Mogotsi may return to the Madlanga Commission of Inquiry, depending on developments linked to upcoming evidence, as he remains in custody after his second attempt to secure bail failed in the Johannesburg Magistrate’s Court.

Mogotsi is facing charges including perjury, defeating the ends of justice, and unlawful possession of a firearm, linked to an alleged staged assassination attempt in Vosloorus.

His initial bail application was rejected earlier this month after the court found he failed to provide verifiable residential addresses. A renewed bid, which his legal team said was based on new facts, was also dismissed, leaving him behind bars.

Outside court, his lawyer Makau Sekgatja said the legal team is closely monitoring proceedings at the Madlanga Commission, where Mogotsi’s involvement could be affected by upcoming testimony.

“He is not ruling out a return to the Madlanga Commission if SAPS Crime Intelligence boss Major General Feroz Khan’s affidavit implicates him,” Sekgatja said.

The testimony of Khan was expected this week but has been delayed after the commission moved to first consult his legal representatives following an attempted assassination on him.

Sekgatja said the defence is awaiting clarity on the matter before deciding on further legal steps, adding that they are “monitoring developments closely”.

Mogotsi remains in custody as both the criminal case and the commission process continue to unfold.
