The bail application of the two men accused of the rape and murder Sinoxolo Mafevuka who was found dead in a toilet is expected to take place in the Khayelitsha Magistrate’s Court on Monday.

The two people arrested are cousins of her boyfriend and before she died they had apparently confronted her about leaving a bar with another man.

According to testimony by the investigating officer Constable Isaac Tshabalala at the previous hearing, they also allegedly tried to assault the man she left with, but he fled.

Mafevuka and her boyfriend apparently later made up.

The court also heard that she had tried to find somebody to walk with her to the communal ablution facilities.

Her naked body was found on the toilet with her genitals showing and her head stuck under the toilet cistern. Her clothes and a jersey that did not belong to her were strewn around the scene.

Her murder shocked the community and the police investigation came under fire when they were not getting immediate results and arresting somebody.

Deputy Police Minister Maggie Sotyu visited the area after her murder and demanded to know why the investigation was taking so long.

This was after the quick arrest of a group of men accused of the rape and murder of Tokai schoolgirl Franziska Blöchliger.

Tshabalala also spoke of the difficulty investigators encountered when trying to extract DNA evidence for the case because water had run over Sinoxolo’s body.

The magistrate has ordered that the cousins not be named.
