Motsoeneng lawyer requests SABC to give way forward

The lawyer for SABC COO Hlaudi Motsoeneng Zola Majavu says he has written a letter to the SABC to request the way forward.

Majavu’s statement comes after the Supreme Court of Appeal dismissed Motsoeneng’s application for leave to appeal the Western Cape High Court decision.

He says: “What we have decided to do is to write a letter on his behalf to the SABC as for clarity as to what is it that they intend to do in light of this judgement. We are basically throwing the ball back into the court of those who took the decision to appoint him and once we have received the employer’s response I will then be able to advise him accordingly.”

The SCA found that the Communications Minister Faith Muthambi’s permanent appointment of Motsoeneng was irrational and invalid and should therefore be set aside.

He says their response to the Supreme court ruling will be informed by what his client’s employer will decide to do.

Majavu says: “Mr Motsoeneng does respect the outcome of the court and he has not instructed me to proceed with the concourt application. In fact to the contrary I advised against that approach as I am of the view that there are no constitutional issues that he can raise. He has accepted that advice.”

The DA says Motsoeneng must vacate his office.
